The text commonly known as the Babylonian Poem of Creation has attracted scholarly attention since it was first translated in the late nineteenth century, although critical editions have appeared only recently. In 2014 there was published a lengthy study on enūma eliš that presents a number of original approaches to the ancient composition. This new book is the subject of the following notes.

Enūma eliš exhibits a masterful array of intertextual borrowings that makes it exceptional among Akkadian literary texts. In this paper I discuss “intertextu- ity” as an analytical category and its suitability and limitations for the study of ancient compositions. I consider three different levels of intertextuality and present instances from an assorted group of texts. I finally show how a variety of intertextual types that are usually found in isolation are combined in Enūma eliš to create an original piece.

Eli Feiring has developed a concept of forward-looking responsibility in healthcare. On this account, what matters morally in the allocation of scarce healthcare resources is not people's past behaviours but rather their commitment to take on lifestyles that will increase the benefit acquired from received treatment. According to Feiring, this is to be preferred over the backward-looking concept of responsibility often associated with luck egalitarianism. The article critically scrutinises Feiring's position. It begins by spelling out the wider implications of Feiring's (...) view. Against this background, it shows that (i) Feiring's distinction between backward-looking and forward-looking responsibility is incompatible with the Scanlonian notion of responsibility she apparently endorses; (ii) her favoured forward-looking notion of responsibility is subject to the objections levelled against the luck egalitarian view (whatever the strength of such objections). Frederick J. Antczak opens with a brief introduction that previews the five sections to come: “Situating Booth”; “Ethics and Fictions”; “Rhetoric and Politics”; “Booth across Disciplines”; and “Booth, Assent, and Argument.” Booth’s Afterword is followed by Lee Artz’s bibliography of Booth’s work.For readers primarily interested in rhetoric, Walter Jost’s “Teaching the Topics: Character, Rhetoric, and Liberal Education” provides a thoughtful exploration of Booth’s contributions to a theory of special topics as well as a strategy for using this theory as a means of integrating liberal education. Those more interested in philosophy may turn first to Alan Brinton’s rereading of Booth’s Modern Drama and the Rhetoric of Assent against Brinton’s own understanding of the Cartesian tradition, or to James McOmber’s comparison of Booth, Richard Rorty, and Paul Feyerabend in “Rhetoric without Sophistry.” And those with a primary interest in teaching should be pleased to find that [End Page 276] subject given strong treatment here in Francis-Noel Thomas’s use of Booth’s practice of criticism, and its relationship to the work of all teachers of English, in taking on advocates of a narrowly-conceived cultural literacy. Patsy Callaghan and Ann Dobyns use a Boothian ethics of argument to inform the teaching of first-year English classes.Literature, of course, is featured throughout. Monica Johnstone arrestingly reads Genet’s Querelle against the evaluative model Booth elucidates in The Company We Keep; Susan Shapiro tests Boothian ethical criticism in the case of Elie Wiesel’s post-Holocaust fiction; and Antczak discusses Martin Luther King’s “Pilgrimage to Nonviolence.” Two essays, one by Don Bialostosky and one by David Richter, relate Booth’s work to Bakhtinian principles, though with very different ends and effects. Finally, those who wonder whether Booth’s brand of pluralism shies too far away from a rigorous encounter with politics will gain from James Phelan’s careful and convincing extension of Booth’s evaluative criticism and from Barbara Foley’s insistence that Booth’s system of ethical criticism too often ignores or elides issues of class and race.The richest section of this text for me, however, focuses on “Booth across Disciplines.” In three remarkably provocative and highly readable discussions, Peter Rabinowitz, Donald McCloskey, and Eugene Garver take Booth on the road, applying or extending his work to an analysis of the ethics of music (Rabinowitz), the rhetoric of economics (McCloskey), and the significance of the implicit, of “What Goes Without Saying: in Francis Bacon’s Essays (Garver). One mark of important thinkers is surely that they enable creativity, that their thinking sparks the thoughts of many others. Throughout this volume, but particularly in this section, that mark of Booth’s influence is palpably evident.As I read through Rhetoric and Pluralism, and especially when I came to Booth’s playful and multivocalic Afterword, I kept wishing that someone had contributed a piece of oral history to this volume: Booth is still working, still working hard, and there are many more of his range of selves available to us in his spoken voice. Finally, I longed for a detailed analysis of some of Booth’s playful and ironic pieces, which come in for some mention here and there but are not featured in any essay. This openness to play, so much a part of the rhetorical tradition and so necessary to any ethics of postmodernity, is another of Booth’s gifts to all readers.Andrea A. At the end of the fifteenth century, the Castilian-Aragonian Eli Habilio wrote what is now the only extant, complete, and original Hebrew commentary on the entire Metaphysics of Aristotle. This commentary is short, about 15 folio pages long, and consists almost entirely of quotations from Averroes’ Middle Commentary on Aristotle’s Metaphysics in the early fourteenth-century translation of Qalonimos ben Qalonimos. Yet Habilio elsewhere expresses only disdain for Averroes and hopes that Jews will turn away from Averroes to read Scotus’ metaphysical (...) works instead. The author’s claim is that Habilio’s Commentary is intended to supplement his translation of Antonius Andreas’ questions on the Metaphysics and provide a Hebrew summary of the most read Hebrew version of the Metaphysics that would choose its words in such a way as not to contradict Scotus and in some cases even to encourage its readers to seek out a Scotist approach. In Andreas Stokke (ed.), Festschrift for Matti Eklund, 2024. -/- Replies to Katharina Felka and Nils Franzén, Eli Hirsch, Dan Korman, David Liebesman, Øystein Linnebo, Anna-Sofia Maurin and Debbie Roberts. Topics discussed concern metaethics, metaphysics and philosophy of language. More specifically, issues discussed are thick concepts (Felka and Franzén; Roberts), ontology (Hirsch, Linnebo), indifferentism and fictionalism (Korman), alien languages and alien metaphysics (Liebesman), and Bradley's regress (Maurin).

Alethic pluralism holds that there are many ways of being true. Such a view has been challenged to make sense of the standard account of logical validity as necessary truth preservation. In this paper, the recent solution elaborated by Aaron Cotnoir, based on an algebraic approach, is shown to be untenable. Some reflections about the relation of many-valued logics with truth pluralism are also discussed.

In this paper I use data from interviews conducted with coral scientists to examine the socio-ecological dimensions of science, i.e. how science shapes and is shaped by the living world around it. I use two sets of ideas in particular: niche construction and socio-ecological value frameworks. Using these I offer socio-ecological criteria by which coral scientists evaluate the activities of coral science, more specifically which living systems are intended to benefit from coral science as an activity, and the motivations behind (...) this. The overall picture I present is one of coral science as activity primarily aimed at sustaining a diverse set of living systems, including humans, other organisms, species, and ecosystems, and the social practices associated with these. The value relations between scientists and aspects of these processes dictate how they respond to shifts in the socio-ecological context coral science is embedded in, explaining why the activities associated with coral science are changing as reef ecosystems are threatened. The implication is that natural sciences more generally are entangled with a greater number of social and ecological process than is typically considered, and that shifts in the activities undertaken by scientists may be driven by ecological as well as social and epistemic processes. The notion of truth is a central subject both in Philosophy and Mathematical Logic. The logical approach on the one side and the philosophical one on the other, however, mostly deal with problems which, apparently, require different tools to be tackled. In this paper I argue that such a separation can and should be overcome, and, in order to build a bridge, I focus on the philosophical issue of the insubstantiality of truth, which is a crucial topic to distinguish inflationist (...) from deflationist proposals. Elaborating on the interpretation of insubstantiality in terms of the sparse/abundant classification of properties, I put forward a refined version in which certain flaws afflicting other formulations are solved. Then, I show how, using this improved variant, the philosophical notion of abundance can be fruitfully related to the formal notion of expandability of models, if a logical framework is adopted. Among other virtues, the obtained link can shed new light on the debate of deflationism and conservativity. (shrink)

What we observe, through our usually limited lens, is that differential growing of space determines forms -characterized by their shape, size and coloration. As non-Euclidean geometrical mathematics have proclaimed: forms are manifestations of the curvature of space. Physics and other natural laws impose mathematical structural restrictions to biological forms. The molecules comprising any living form become arranged in specific ways in response to physical forces as well as chemical and biochemical conditions. Over time, such forms inherit additional historical restrictions that (...) make up their meaning, their semiotics. Color does not escape from this orthogenic reality. In this study, we present the colored pattern of the connexivum of Triatoma maculata, an insect vector of the etiologic agent of Chagas disease. This model is used as an example to appreciate mimicry under a heterodox and provocative approach. We unveil that beyond 1) mathematical and 2) historical semiotic restrictions of T. maculata mimesis of a yellowish-black alternating pattern, there are also 3) artistic interpretations; where metaphysics of life, beyond human perspective, is included. This article addresses a strange investment within ‘continental' philosophy, in asserting the impotence of a Derridean approach when it comes to addressing practical (juridical, political, ethical, economic) issues. Such assertions of impotence regularly stand as the foil for whatever is proposed as a more complex, and therefore powerful, means to make sense of concrete phenomena. Invariably, however, the criticism of a Derridean approach is based on reductive misconceptions of its complex logic, and the proposed correctives repeat the very pattern of (...) thinking that Derrida has consistently adopted throughout his writing. A case in point is Zizek's criticism of what he calls ‘Derrida's operation.' While Zizek's critique is more nuanced and contemporary than the hackneyed charge of ‘textualism,' his reductive conception of the logical structure of Derridean thinking remains open to challenge. Further, his Lacanian corrective, whose logic is represented by the figure of a ‘Borromean knot,' precisely matches the ‘plural logic of the aporia' that underpins a Derridean approach to concrete phenomena. Accordingly, what follows is an attempt to show how Lacanian and Derridean discourses can be brought into alliance as a consequence of their isomorphic logical structure. This attempt is motivated by the conviction that one can do well without the pseudo-antagonism generated by the unjust criticism directed at one another by like-minded thinkers, which, moreover, provides such thinkers with a far too facile excuse for dismissing one another, even before opening texts. I also have a hidden agenda of sorts, which is to outline and, indeed, promote the ‘complexity-thinking' characteristic of both Derridean and Lacanian discourses, as the most viable and appropriate approach to practical issues. The model presented by the authors can explain an inherent contradiction in people's naïve theory of time. In this commentary I suggest a way in which another paradox of our phenomenal temporality may be addressed along these lines. In the final section, I also discuss some concerns that may arise about the clear-cut distinction between humans and non-human animals.

Knowledge and Self-Knowledge in Plato's "Theaetetus" examines the dialogue in conversation with others, arriving at the conclusion that it is the absence of self-knowledge in the Theaetetus which leads to its closing impasse regarding knowledge. What Socrates accomplishes in the dialogue is to lead the mathematician Theaetetus to the recognition of his ignorance—the first step toward self-knowledge.

In this paper, I demonstrate how philosophical insights and empirical research on the use of religious language can be fruitfully combined to tackle issues regarding the ontology of religious collectivities and the agency of group actors. To do so, I introduce a philosophical framework that draws on speech act theory and recent advances in the fields of collective intentionality and social ontology, with particular attention paid to the work of Raimo Tuomela. Against this backdrop, I discuss a brief case study (...) based on my fieldwork among Jehovah’s Witnesses in Switzerland and Germany. In particular, I call attention to the structure of the Witnesses’ ritual interactions and to the types of speech acts that are performed in their congregational settings. I argue that the communicative framework provided by these rituals is particularly suited to the creation of genuine group intentions that cannot be reduced to the private intentions of the individual group members. In conclusion, I argue that most of the language used in religious contexts does not deviate much from everyday language; however, particular ritual settings can elicit performative effects and constitute new social realities that can have a concrete impact on both individuals and religious groups. Phenomenology has been defined by Husserl as “theory of the essences of pure phenomena,” yet the ontological status of essences in Husserlian phenomenology is far from a settled issue. The late Husserlian emphasis on genetic constitution and the historicity of the lifeworld is not immediately reconcilablewith the ‘unchangeable’ nature that is prima facie attributed to essences. However, the problem of the nature of ideality cannot be dropped from phenomenological accounts without jeopardizing the phenomenological enterprise as such. Through an immanent analysis (...) of Husserl’s meditation on essences a positive account of their ontological status is provided. Essences are interpreted as ontological thresholds, primordially rooted in our motivated confrontation with sensuous transcendence. Essences appear as emergent ontological features, which are not reducible to their particular realizations and which exhibit a fundamental continuity between consciousness and being. They manifest themselves as prospectively a priori (a precondition for further experiences), but retrospectively a posteriori (they are founded in experience). Finally, essences manifest the ‘co-essential’ nature of consciousness and sensuous transcendence: they are the way in which we are motivated and constitutively bound to articulate being, which in turn is apt to be thus articulated. We investigate a contractionless naive set theory, due to Grisin [11]. We prove that the theory is undecidable.

A notion that the theologians consider as a physical explanation model while discussing the movement in accordance with their theological views on the comprehension and interpretation of the universe is i‘timād. In conclusion, this notion, which has various meanings in different contexts, has been used to express “the tendency of object in motion, potential energy, pressure or resistance of an object to another object”. Within this framework, including weight-lightness, ascent-descent, impulse-pull etc., many phenomena related to the unidirectional and compulsory movement (...) of objects have been explained. On the other hand, theologians dealt with i‘timād in the context of their own conceptions of the universe, in relation to their understanding of causality while discussing the movements of bodies in the universe and their changes-transformations, and the causality relationship between them. As a result of their discussions, they asked questions about i‘timād and tried to find answers to these questions in the perspective of their own views of the universe. Furthermore, in relation to the theory of i‘timād, Mu‘tazilite scholar Abû Ishâq Ibrâhîm al-Nazzâm (d. 231/845) discussed the theory of tafra (leaping) and put forward contrary arguments. One of those who sought answers to the questions discussed in this direction and expressed an opinion on i‘timād is the Ash’arî theologian Abû al-Maâlî al-Juwaynî (d. 478/1085). He discussed i'timād in terms of the accidents of spatial generation and used i'timād as a universal explanatory theory for the phenomena of movement, space, weight and lightness, and directional phenomena such as up and down. From this point of view, he also tried to interpret i'timād with examples from natural phenomena and objects. In doing so, he synthesized i'timād within his own system and presented it as an explanatory element by considering the Ash'arite metaphysical principles through the examples he frequently gave. Thus, he put forward views on whether the movements of objects give rise to i'timād or not, and drew attention to the usage of i'timād in the Muʿtazilite and Ashʿarī schools. In this context, he tried to prove with examples whether the Muʿtazilite understanding of iʿtimād overlaps with the Ashʿarī understanding of iʿtimād. On the other hand, al-Juwaynī put forward his proofs in the context of his criticisms of the Muʿtazilites in general and al-Naẓẓām in particular. His criticisms were generally in response to the views of Muʿtazilite scholars on the phenomenon of motion in the context of iʿtimād. In fact, al-Juwaynī criticized the arguments of Abū ʿAlī al-Jubbāʾī (d. 303/916) and Abū Ḥāshim (d. 321/933) in the context of the theory of tawlīd and al-Naẓẓām in the context of the theory of tafra through their arguments. In this direction, the paper concentrates on how Juwaynî stated the examples he put while proving the theory of i‘timād in terms of movement phenomenon and what he comprehended from it. In addition, the paper discusses his criticisms against Nazzâm’s theoretical and experimental arguments he brought in the context of tafra theory while elaborating Juwaynî’s explanation of movement phenomenon. Mu‘tezilî düşünür Amr b. Bahr el-Câhız’ın (ö. 255/869) tercüme faaliyetleri sonucu Antikite (Antik Çağ) Yunanca metinlerden yaptığı aktarımlar canlılar hakkındaki fikirlerini etkilemiştir. Böylece Yunan zoolojisinde ortaya koyulan görüşlere Kitâbü’l-Hayevân eserinde geniş bir şekilde yer vermiştir. Ayrıca diğer eserlerinde az da olsa Yunan düşünürlerin hayvanlar hakkındaki görüşleri mevcuttur. Ancak Yunan zoolojisinden tevarüs eden birikimin Câhız’ın Kitâbü’l-Hayevân eseri olmak üzere hangi bağlamda ve ne düzeyde alımlandığı tam olarak bilinmemektedir. Alımlanan bilgilerin Câhız’ı ne kadar etkilediği ve doğrudan mı yoksa kendi ilmî birikiminin süzgecinden (...) geçirerek mi? Aktardığı net olarak ortaya koyulmamıştır. Buradan hareketle bu çalışmada, Câhız’ın hayvanlar hakkındaki görüşleri temel alınarak Yunan zoolojisinden etki düzeyi ortaya koyulmaya çalışılacaktır. Böylece Câhız’ın “Sâhibu’l-Mantık” lakabıyla bahsettiği Aristoteles (mö. 384-322) başta olmak üzere Galen (ö. 200?) ve Polemon (Aflimun) (ö. 314) gibi Yunan düşünürlerden hangi noktalarda aktarımlar yaptığı üzerinde durulacaktır. Bu bağlamda Câhız’ın Kitâbü’l-Hayevan eseri başta olmak üzere diğer eserlerinde geçen Yunan zoolojisine dair ifadeler açığa çıkarılacaktır. Fakat özellikle Aristoteles’ten yaptığı aktarımlar oldukça fazla olduğundan dolayı Câhız’ın tam olarak anlayamadığı, araştırdığı, doğrudan etkilendiği ve test ettiği bilgiler üzerinde analiz yapılacaktır. Çalışma sonucunda Câhız’ın alımladığı bilgileri bazen doğrudan bazen doğruluğunu araştırarak hatta deney ve gözleme başvurarak aktardığı anlaşılacaktır. (shrink)

Bu çalışma Ebü’l-Hasan el-Eş’arî’nin (ö. 324/935-36) âlem anlayışının Ehl-i Sünnet’in kozmoloji anlayışına etkisini ihtiva etmektedir. Bu bağlamda onun âlem ve âlemin unsurlarına (cevher, araz, cisim, mekân, hareket, nedensellik) yönelik fikirleri ele alınıp irdelenmeye çalışılmıştır. Eş’arî’nin, mensubu olduğu Mu’tezile’den ayrıldıktan sonra dakîk konularda aldığı birikimi kendi yöntemiyle nasıl mezcettiği ve başta Eş’arî’lik ekolü olmak üzere Ehl-i Sünnet ekolüne aktardığı tespit edilmiştir. Bu açıdan Eş’arî’nin mezkûr fikirlerinin Ehl-i Sünnet’in kozmoloji anlayışında yer edinip-edinilmediğine değinilmiştir. Öte yandan Ehl-i Sünnet’in kozmoloji anlayışının kurulmasında başat rol (...) oynayan kelâmcının Bâkıllânî (ö. 403/1013) olduğu yönündeki iddialara da cevap verilmeye çalışılmıştır. Bu iddiaların aksine Eş’arîlik ekolünün kurulmasına öncülük eden Eş’arî’nin dakîk konulardaki görüşlerinin Ehl-i Sünnet’in kozmoloji anlayışının meydana gelmesinde öncü rol oynadığına yer verilmiştir. Çalışma Eş’arî’nin âlem anlayışı ve bu anlayışın Ehl-i Sünnet’in kozmoloji anlayışına etkisi ile sınırlı tutulmuştur. Öte yandan yer yer diğer kelâm ekollerinin ve kelâmcıların dakîk konulardaki görüşlerine de başvurulmuştur. Bu minvalde argümanlar getirilmeye ve analiz edilmeye çalışılmıştır. In this paper I begin to fashion a theory of musical form that I call historical formalism. Historical formalism posits that our perception of the formal properties of a musical work is informed by considerations not only of artistic categories but also of the historical, sociopolitical, and cultural circumstances within which that work was composed.

: This paper combines Simondon’s philosophy of individuation with some aspects of post-humanist and‘new materialist’ thought, while, at the same time, remaining within the ambit of a more classically ‘historical’characterisation of materialism. Two keywords drawn from Karen Barad and Simondon respectively – ‘ontoepistemology’and ‘axiontology’ – represent the red thread of a narrative that connects the early modern invention of civil science to Wiener’s cybernetic theory ofsociety. The political stakes common to these forms of what I call ‘banal’ materialism, Simondon attacked (...) ontologically,epistemologically and politically. The conceptual tools Simondon’s philosophy of individuation elaborates prove tosupport a ‘non-banal’ materialist critique of the alleged ‘unsocial sociability’ of human nature theorised in modernpolitical theory. A genuine materialist approach, as I will argue, allows us to shift political thinking from politicsconceived as a problem to be solved to politics as an arena of strategic experimentation. (shrink)

Human genetic research databases cast a new light on the controversial issue of which uses of the human body are morally permissible. More specifically, banking human tissue raises issues relating to the ownership of the samples that the participants have donated, to the ownership of the data that are derived through processing the donated samples, and to the management arrangements that better balance the interest of genetic research with the protection of participants' rights. Winickoff & Winickoff suggest that the charitable-trust (...) model is a superior legal arrangement for biobanking compared with private biobanking. This paper critically assesses Winickoff & Winickoff's claim by highlighting some areas of implementation where such a model could be problematic. The charitable trust is certainly an advantageous arrangement because (1) it favors the separation between control and use of the samples, (2) it provides a procedural mechanism that facilitates the participation donor groups in the biobank management and (3) it mediates the different interests that are affected. On the other hand, the charitable-trust model leaves unresolved several issues--among them the ownership of the sample, the right of withdrawal, access and funding mechanism. I conclude that further theoretical and empirical analysis is required in the area. (shrink)

The article reviews Italian semiotician and philosopher Umberto Eco’s vision of semiotics as a discipline, the aim of which is to study the ‘whole of culture’. It focuses especially on Eco’s trajectory out of structuralism and on the development of a cognitive semantics based on strong pragmatist principles, that inform his notion of interpretability as the key process of semiosis and on the encyclopedia as the format more apt to describe the cultural space. After a consideration of the interface between (...) the cognitive, the pragmatic and the cultural dimensions of semiosis, the article highlights a few open problems in contemporary, culturally-oriented sociological theory that could benefit from a deeper engagement with these concepts. In der zeitgenössischen Erkenntnistheorie ist die Idee verbreitet, dass der Erwerb von Wissen davon abhängig ist, dass das Subjekt des Wissens an einer bestimmten Lebensform teilhat, die grundlegender als sein Wissen ist. Das ist eine Lesart der Position Wittgensteins, deren exemplarischer Vertreter etwa Stanley Cavell ist. Meine These dagegen lautet, dass die Lebensformtheorie einem erkenntnistheoretischen Dogma aufruht, dessen Überwindung Wittgensteins eigentliches Anliegen war: Es ist das Dogma, dass die grundlegende Bedeutung des Wissensbegriffs in der Beschreibung eines einzelnen Aktes besteht, und (...) nicht in der Beschreibung von etwas, das auf einer logisch anderen Ebene steht: nämlich einer Fähigkeit. Damit soll nicht bestritten werden, dass die Idee einer bestimmten Lebensform wesentlich ist für die Beschreibung erkenntnisfähiger Subjekte. This volume offers a new framework for understanding expertise. It proposes a reconceptualization of the traditional notion of expertise and calls for the development of a new contextual and action-oriented notion of expertise, which is attentive to axiological values, intellectual virtues, and moral qualities. -/- Experts are usually called upon, especially during times of emergency, either as decision-makers or as advisors in formulating policies that often have a significant impact on society. And yet, for certain types of choices, there is (...) a growing tension between experts’ recommendations and alternative views. The chapters in this volume critically assess the idea of whether possessing epistemic authority can automatically make someone’s assertions necessarily more grounded than others. They not only evaluate the epistemological implications of this idea but also reflect on its ethical, socio-cultural, and political consequences. The interdisciplinary framework advanced across the chapters seeks to overcome certain limitations that underlie current models of expertise by adopting more inclusive and representative decisions that can improve the perceived neutrality of experts’ decisions. Increasing neutrality means reducing cases in which an unidentified bias – be it a scientific one or not – puts any of the individuals involved in a specific public choice at a systematic disadvantage. -/- Philosophy, Expertise, and the Myth of Neutrality will appeal to scholars and advanced students working in epistemology, philosophy of science, philosophy of the social sciences, public policy, and sociology. Cancer registries are an important part of the public health infrastructure, since they allow to monitor the temporal trends of this illness as well as facilitate epidemiological research. In order to effectively set up such registries, it is necessary to create a system of data collection that permits to record health-related information from patients who are diagnosed with cancer. Given the sensitive nature of such data, it is debated whether their recording should be based on consent or whether alternative arrangements (...) are possible (eg, opt-out systems where information is automatically collected but patients can later withdraw). In the recent reform of the Swiss cancer registration legislation, the lawmaker set out to implement rules about the recording of data in cancer registries that would allegedly go beyond a consent-based model, in order to balance accurate registration with respect of patient rights. However, by analysing the operational norms of the new legislation and comparing them with those of other systems, it emerges that the Swiss rules de facto closely resemble a system of registration based on informed consent—in partial contradiction with the objective pursued by the lawmaker. In this paper, we show how the details of a policy are crucial to determine its true nature and we highlight some critical elements—from an ethical standpoint—of the recently reformed Swiss policy on cancer registration.
